BACKGROUND:

This agreement applies as between you, the User of this Web Site and Valley Approvals , the owner(s) of this Web Site. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these terms and conditions, you should stop using the Web Site immediately.

 

Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

Privacy

If you make an application, your information may be sent to additional 3rd parties for further loan options who may also search your record with the credit reference agencies. Your information will also be checked with fraud prevention agencies and if false or inaccurate information is provided and fraud is identified, details will be passed to fraud prevention agencies to prevent fraud and money laundering.

You authorize us to make all inquiries necessary to verify this information to enable us to consider this application. By agreeing to the terms and conditions when making your application, you are giving your consent for your information to be used by Valley Approvals for administrative, underwriting, marketing and revenue purposes. Under the terms of the act you have the right to obtain a copy of the information held about you upon payment of the appropriate fee.

You agree that, if you have provided Valley Approvals with personal data relating to a third party (1) you have in place all necessary appropriate consents and notices to enable lawful transfer such personal data to Valley Approvals and (2) that you have brought to the attention of any such third party the Privacy Notice available on the Valley Approvals’ website or otherwise provided a copy of it to the third party. In order to apply for any loan or other product or service via the Site you must be at least 18 years of age and a Canadian resident.

You must ensure that the details provided by you in your application or at any time thereafter are correct and complete and inform us immediately if there are any changes to those details. If any of the information provided has been falsified or misleading, Valley Approvals reserves the right to immediately reject your application.

Before proceeding with any loan or other product or service with the product provider, you should take independent advice.

We will not be responsible for any breach of these Terms or otherwise for any delay or failure in processing your application for any loan or other product or service where such breach, delay or failure is attributable to you and/or any third party or is otherwise caused by circumstances beyond our control.

You agree not to bring any claim against us arising from your application for or use of any loan or other third party product or service via the Site and, as Valley Approvals will not be a party to any contract or arrangement under which you obtain any loan or other product or service from a third party directly or indirectly through the Site.

Your sole recourse in respect of any performance, non-performance or delay in performance of the contract or arrangement by that third party will be against that third party and subject to all liability of Valley Approvals, its officers, employees, agents, partners, and sub-contractors is excluded to the fullest extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, Valley Approvals accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.

Nothing in these terms and conditions excludes or restricts Valley Approvals’ liability for death or personal injury resulting from any negligence or fraud on the part of Valley Approvals.

Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977 (UCTA). However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

Disclaimer

We do not guarantee that any loans or other products or services offered to you through the Site will meet your requirements. In connection with loans, it is our aim find you a competitive loan from a lender on our panel of lenders. This is based on your application and relevant circumstances. We do not guarantee that any loan which is offered to you is at the cheapest rate and/or on the most favourable terms which are available in the market.

Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

Notices

All notices / communications shall be given to us either by phone on 1-888-205-3114 or by email to valleyapprovals@gmail.com. Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

Headings for each section have been included above for your convenience, but such headings do not have any legal meaning, and may not accurately reflect the content of the provisions they precede.

Severability

If any part of these Terms of Services is unlawful, void or determined to be unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.

Law and Jurisdiction

These terms and conditions and the relationship between you and Valley Approvals shall be governed by and construed in accordance with the Law of Canada and Valley Approvals and you agree to submit to the exclusive jurisdiction of the Canadian Courts.
